1. Definitions and Scope
These Terms and Conditions regulate the contractual relationship between Revolt Group (hereinafter, 'The Provider') and the natural or legal person contracting our services (hereinafter, 'The Client'). Revolt Group provides server infrastructure management, custom software development, and digital identity management services. By contracting any of these services, The Client accepts these conditions without reservation.
2. Nature of Services (MSP)
Revolt Group acts as a Managed Service Provider (MSP). We do NOT own the physical data centers. Our work is limited to the administration, configuration, optimization, and maintenance of software and operating systems. Revolt Group is not responsible for hardware failures, power outages, or network interruptions attributable to underlying infrastructure providers (e.g., Oracle, HolyHosting, AWS), acting solely as a technical intermediary for the resolution of such incidents.
3. Software Development and Intellectual Property
For development services (Plugins, Webs, Apps): (a) Revolt Group retains ownership of all pre-existing code and proprietary libraries used. (b) Intellectual property of the final product is transferred to the Client only upon payment of 100% of the agreed price. (c) Revolt Group reserves the right to use generic code fragments developed for other projects, provided they do not violate the confidentiality or trade secrets of the Client.
4. Billing, Payments, and Suspension
Recurring services (network maintenance, web hosting) are paid in advance from the 1st to the 10th of each month. Failure to pay after 5 calendar days from the due date entitles Revolt Group to temporarily suspend services without prior notice. Failure to pay after 30 days will result in contract termination and irreversible deletion of hosted data and configurations, without right to claim for loss of information.
5. Refund Policy and Warranty
Due to the intangible nature of our services and immediate operating costs: (a) No refunds are offered for administration services already started or current months. (b) For custom developments, the advance payment (down payment) is non-refundable once work has begun. (c) Revolt Group guarantees the operation of delivered software for a period of 30 days post-delivery for bug fixes; subsequent modifications will be quoted separately.
6. Limitation of Liability
To the maximum extent permitted by Argentine law, Revolt Group shall not be liable for indirect damages, lost profits, loss of data, or business interruption resulting from: (a) Cyberattacks (DDoS, Hacks) exceeding our standard protection barriers; (b) Client negligence in handling access credentials; (c) Third-party updates (e.g., Mojang, Microsoft) breaking compatibility with existing systems.
7. Client Obligations (Acceptable Use)
The Client agrees not to use the infrastructure managed by Revolt Group for illicit activities, including but not limited to: unauthorized cryptocurrency mining, SPAM sending, hosting illegal material, or attacks on third parties. Detection of such activities will result in immediate contract rescission and reporting to competent authorities.
8. Confidentiality
Both parties agree to maintain strict confidentiality of all technical, commercial, and strategic information exchanged during the service term. This obligation shall subsist for a period of two (2) years following contract termination.
9. Jurisdiction and Applicable Law
These terms are governed by the laws of the Argentine Republic. For any controversy arising from the provision of services, the parties submit to the exclusive jurisdiction of the Ordinary Courts of the Province of Mendoza, waiving any other forum or jurisdiction that may correspond to them.
